Terms and Conditions
1. Introduction
a. The UN Booking Hub (referred to as "the Platform") is a service provided by the World Food Programme (WFP) to facilitate bookings and streamlining of various services, including but not limited to transportation, accommodation, professional services and more.
b. By accessing and using the Platform, you agree to comply with these Terms and Conditions.
2. User Responsibilities and Indemnification by User
a. You must be of legal age and have the authority to enter into a binding agreement.
b. You are responsible for providing accurate and complete information during the booking process.
c. You agree to use the Platform for legitimate purposes and in compliance with applicable laws and regulations.
d. You must be authorized by your organization to access and use the UN Booking Hub.
e. You are responsible for maintaining the confidentiality of your account and password.
f. You agree to use the UN Booking Hub solely for authorized purposes and in accordance with applicable laws and regulations.
g. You will not attempt to gain unauthorized access to the UN Booking Hub or interfere with its proper functioning.
h. User shall not remove, obscure, or alter any legal notices displayed in or along with the materials or site features.
i. WFP reserves the right to seek all remedies available by law for any violation of these Terms of Use, including any rights of WFP in the UN Booking Hub, its materials, site features, and the submissions. No waiver by WFP of any provision of these Terms of Use shall be binding except as set forth in writing and signed by its duly authorized representative.
j. The UN Booking Hub may contain advice, opinions, and statements from various information providers. WFP does not represent or endorse the accuracy or reliability of any advice, opinion, statement, or other information provided by any information provider, any User of the UN Booking Hub, or any other third party. Reliance upon any such advice, opinion, statement, or other information shall also be at the User's own risk.
k. The UN Booking Hub may contain links and references to third-party websites. The linked sites are not under the control of WFP, and WFP is not responsible for the content of any linked site or any link contained in a linked site. WFP provides these links only as a convenience, and the inclusion of a link or reference does not imply the endorsement of the linked site by WFP.
3. Booking Process
a. The solution enables you to search, select, and book various services provided by UN organisations and relevant third-parties.
b. The availability and terms of services are determined by the respective parties.
c. By making a booking through the Platform, you acknowledge and agree to abide by the terms and conditions of the specific service provider.
4. Payments and Financial Transactions
a. The Platform may facilitate payments for bookings made through the system.
b. Payment processing is subject to the terms and conditions of the payment service provider.
c. You are responsible for providing accurate payment information and ensuring the timely completion of transactions.
5. Service Providers and Third-Parties
a. The Platform may provide links or references to third-party service providers, websites, or applications.
b. The quality, accuracy, or safety of services provided are responsibility of each individual service provider where UN Booking Hub acts as a collector to simplify communication.
c. You acknowledge and agree that the UN Booking Hub is not liable for any damages or losses arising from your interactions with service providers.
6. Data Privacy and Protection
a. WFPis committed to protecting your personal information in accordance with applicable data protection laws.
b. By using the Platform, you consent to the collection, use, and processing of your personal data as outlined in the Privacy Policy.
7. Limitation of Liability
a. The UN Booking Hub is provided on an "as is" and "as available" basis.
b. The World Food Programme (WFP) assumes no responsibility for any errors, omissions, or inaccuracies in the content of the UN Booking Hub.
c. WFP shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of your use of the UN Booking Hub.
d. WFP shall not be held responsible for any direct, indirect, incidental, or consequential damages arising from the use of the Platform or services provided.
e. WFP does not guarantee the accuracy, availability, or quality of services provided through the Platform.
8. Intellectual Property
a. Intellectual property rights associated with the Platform, including its content, logos, and trademarks, belong to WFP and UN Booking Hub team. Content, images, logos and trademarks provided by third-party service providers for the presentation of their offering remain intellectual property of each service provider.
b. You may only use the UN Booking Hub and its content for authorized purposes and in accordance with these Terms of Use.
c. You may not reproduce, modify, distribute, or use any intellectual property from the Platform without prior written permission.
9. Termination
a. WFP reserves the right to suspend or terminate your access to the Platform at any time without prior notice.
b. You may terminate your use of the Platform by discontinuing its use and complying with any outstanding obligations.
10. Governing Law and Jurisdiction
a. Nothing in these Terms of Use or Special Terms shall imply a waiver, express or implied, by WFP, the United Nations, and the Food and Agriculture Organization of the United Nations of any privileges and immunities enjoyed by them pursuant to the 1946 Convention on the Privileges and Immunities of the United Nations, the 1947 Convention on the Privileges and Immunities of Specialized Agencies, customary international law, other relevant international or national agreements, and under domestic law.
b. These Terms of Use and any dispute arising therefrom shall be exclusively governed by international principles of international law, to the exclusion of any single national system of law.
c. Any dispute, controversy, or claim arising out of or relating to these Terms of Use, or the breach, termination, or invalidity thereof or the use of the UN Booking Hub, its materials, and site features by the User or any content available therein and their particular terms of use shall be settled by Arbitration in accordance with the UNCITRAL Arbitration Rules then in force. The arbitral tribunal, which shall be composed of 1 (one) arbitrator, shall be empowered to order:
(i) the return or destruction of goods or any property, whether tangible or intangible, or of any confidential information provided hereunder;
(ii) the termination hereof;
or (iii) that any other protective measures be taken with respect to the goods, services, or any other property, whether tangible or intangible, or of any confidential information provided hereunder, as appropriate, all in accordance with the authority of the arbitral tribunal pursuant to Article 26 ("the Interim Measures") and Article 34 ("the Form and Effect of the Award") of the UNCITRAL Arbitration Rules. The arbitral tribunal shall have no authority to award punitive damages. WFP and the User shall be bound by any arbitration award rendered as a result of such arbitration as the final adjudication of any such Dispute. The language of any such proceedings shall be English.
d. To the extent that there exists more than one language version of these Terms of Use and there is any inconsistency between the versions, the English version shall always prevail.
11. Miscellaneous
a. WFP reserves its exclusive right in its sole discretion to (i) alter, limit or discontinue the UN Booking Hub, any materials, or site features in any respect; (ii) modify these general Terms of Use or any Special Terms. WFP shall have no obligation to take the needs of any User into consideration in connection therewith.
b. WFP reserves the right to deny, in its sole discretion, any user access to the UN Booking Hub or any portion thereof without notice and to suspend, revoke, or stop providing user accounts if the User does not comply with the Terms of Use or any Special Terms and remove, for any reason and without notice, any submission.
c. WFP's name, emblem, and abbreviation (the "WFP Marks") are the exclusive property of WFP and are protected under international law. Unauthorized use of the WFP Marks is prohibited. The WFP Marks may not be reproduced or used in any manner without WFP's prior written permission.
d. The mention or omission of specific companies, their products, or brand names on the UN Booking Hub does not imply any endorsement or judgment on the part of WFP.
12. Modifications to Terms and Conditions
a. WFP reserves the right to modify or update these Terms and Conditions at any time.
b. Any changes will be communicated through the Platform or other appropriate means.
